Terms and Conditions

ACCEPTANCE

• Any instructions received by the Seller from the Buyer for the supply of Goods and/or the Buyer's acceptance of Goods supplied by the Seller shall constitute acceptance of the terms and conditions contained herein.
• The buyer constitutes either the wilful owner of the property, the office by which the order was placed, the licensee of the office by which the order was place or a sales agent working for the licensee of the office by which the order was placed.
• Where more than one Buyer has entered into this agreement, the Buyers shall be jointly and severally liable for all payments of the Price.
• Upon acceptance of these terms and conditions by the Buyer the terms and conditions are binding and can only be amended with the written consent of the Seller.
• The Buyer shall give the Seller not less than fourteen (14) days prior written notice of any proposed change of ownership of the Buyer or any change in the Buyer's name and/or any other change in the Buyer's details (including but not limited to, changes in the Buyer's address, facsimile number, or business practice). The Buyer shall be liable for any loss incurred by the Seller as a result of the Buyer's failure to comply with this clause.

PAYMENT

• The Real Estate Products Group Pty Ltd will forward an invoice including confirmation of details and price at the end of each month of which the photography was taken.
• Payments must be received within 60 days from the date of invoice regardless as to when our invoice is received. If payment has not been received within 60 days an account keeping fee will apply at the monthly rate of 1.0% on overdue outstanding balances or $35.00 whichever is the greater.
• After 90 days the account will be handed to Bradbury and Dunnhurst debt collection which charge 20% commission on top of your outstanding account plus a $65 handling fee.
• All payments can be made by either EFT or cheque. See invoices and website for EFT and postal details.
• All credit card payments will incur a 1.6% credit card fee on the total balance due at the time of payment.
• The Real Estate Products Group Pty Ltd will retain ownership of all its products after payment has been received except when purchasing brochures, property styling and home maintenance.

PHOTOGRAPHY

• All photography is copyright of The Real Estate Products Group Pty Ltd (Please refer to the photographers' copyright laws).
• Please inform vendors of the copyright laws when offering photography within vendor paid advertising.
• Photography is to be used for the purpose for which it was commissioned.
• The Real Estate Products Group gives permission to the purchaser of photography to upload to third party web portals but does not constitute a transfer of the ownership of the photography in any way to the third party website. Please make your third party website aware they do not have the right to the photography and must seek the expressed permission of the photographer to on sell or utilise the photography for their own website to make a profit or loss.
• Using the photography for any other purpose without consent of The Real Estate Products Group Pty Ltd or the photographer is strictly prohibited and can incur a penalty depending on the breach of copyright. A copyright fee will apply to use the photography for a purpose other than for which it was commissioned, at the discretion of the photographer or The Real Estate Products Group Pty Ltd.
• Any property photographed by The Real Estate Products Group Pty Ltd for another agency will need to be purchased for $55 including GST after expiration of the agency agreement irrespective of whether the vendor paid for the photography or the agent paid for the photography in first instance. Third party websites may purchase the photography from The Real Estate Products Group Pty Ltd or the photographer at a price to be determined according to the purpose of use and length of use.

VIRTUAL TOUR and VIDEO LINKS

• Virtual Tour and Video URL links will be completed and live to your web site within a maximum of 5 working days after the production of both.
• The Real Estate Products Group Pty Ltd reserves the right to remove virtual tour and video links off the internet without notice if payment is not received within the terms and conditions, unless alternative arrangements have been made before the due date of payment.
• The purchaser agrees to inspect all products once received and notify The Real Estate Products Group Pty Ltd of any defects within 7 working days. This is to ensure that the defects are rectified promptly.

SIGNBOARDS

• Please read our terms and conditions herein when ordering signboards from either The Reef Imaging Trust T/A Reef Imaging or The Real Estate Products Group Pty Ltd (credit application form and trading terms and conditions)
• Please complete the credit application form and post or fax back to the address on the bottom of page 1 of the credit application. No orders will be processed unless a credit application form has been received by either The Reef Image Trust T/A Reef Imaging or The Real Estate Products Group.
